The terms and conditions are a legally binding contract between you, the an account holder and Tack Room Trading Ltd. By using any of our services you are agreeing to the terms.
General
Any transaction is between the buyer and the seller. Tack Room Trading Ltd is not a party to the transaction between the seller and the buyer nor is it liable under it.
We do not provide any warranties or assurances in relation to the items you purchase.
All buyers buy at their own risk and in the event that you have any right, claim or action against any other account holder this is independently.
Tack Room Trading Ltd and account holders will have access to personal information (user ID, and location), we are therefore separate and independent data controllers of personal information. This means each party is responsible for the personal information it processes and if personal information is accidently disclosed by a member, Tack Room Trading Ltd will not be held responsible.
If Tack Room Trading Ltd is sued, fined or incurs expenses because of something an account holder has done as a joint data controller of personal information, the an account holder agrees to indemnify Tack Room Trading Ltd for the expenses it occurs in connection with this.
Terms of Acceptable Use
You may use Tack Room Trading Ltd only for lawful purposes.
You may not use Tack Room Trading Ltd in any way that breaches any applicable law and regulations, that is unlawful or involved the sale of counterfeit or stolen items.
You may not use Tack Room Trading Ltd to transmit or procure the sending of any unauthorised advertising, promotional material or knowingly transmit any data, send or upload material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs.
You agree to make sure your posts comply with all applicable laws, regulations and industry codes of practice.
You are solely responsible for your posts and your account. We are not responsible or liable for the content or accuracy of any content posted by you or any other account holder.
All photographs used by a seller must have prior content of the photographer.
Messaging Service
We are under no obligation to oversee our messaging service but will endeavour to make sure we limit risks for users, and we exclude our liability for any loss or damage arising from the use of this messaging service. You must not use the messaging service to send unsolicited advertising or marketing. Please use common sense when handing out personal details to others. You must not use messaging service to knowingly harass, threaten, blackmail or abuse another user.
Accounts
You must be over 18 to create an account.
Your username must not contain any swear words or expletives or imply any connections with us.
You must be legally capable of entering into a binding contract.
We may change our membership prices from time to time, in which case you will be notified before annual renewal.
Following your initial subscription, your Tack Room Trading Ltd membership will be automatically renewed. You may opt out of the automatic renewal at any time. Payments made by you before you cancel will not be refunded. This does not affect your statutory rights.
Limitation of Liability
We hereby expressly exclude;
all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
any liability for any indirect, direct or consequential loss or damage incurred by any user in connection with Tack Room Trading Ltd or in connection with the use, inability to use, or results of the use of Tack Room Trading Ltd, any materials posted on it, including, without limitation any liability for:
loss of income or revenue, loss if business profits or contracts, loss of savings or data.
for any other loss or damage of any kind, however arising even if foreseeable, and whether caused by tort, breach of contract or other means, provided that this condition shall not prevent claims for loss of or damage to your legitimate property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
Nothing in these Terms limits or excludes our liability for death or personal injury arising from our negligence, or our liability for our fraudulent misrepresentation or our misrepresentation as to a fundamental matter nor for any other liability which cannot be excluded or limited under applicable law.
Breach of Terms
Tack Room Trading Ltd may without notice remove content, issue warnings to users and temporarily or indefinitely suspend or terminate an account and prohibit use of the site if we believe a user has breached this agreement/
